Brief descriptions of the various legal areas:
Immigrant Visas - Lawful Permanent Residence (Green Card)
To qualify for permanent residence, an applicant must have or be one of the following:
- A spouse or minor child of a U.S. citizen
- A parent, adult child or sibling of an adult U.S. citizen
- A spouse or minor child of a lawful permanent resident
- An employee that a U.S. employer has received approval from the Department of Labor to hire
- A person of extraordinary or exceptional ability
- A refugee or asylee fleeing persecution
- An approved application in the visa lottery.
EB-5 ("Investor") Visas
The EB-5 Visa provides the most flexible path to a green card based on a US investment. The EB-5 visa does not require the applicant to manage the day-to-day affairs of a business. One may invest in an existing business, or a new business. More than one person may invest in the same business. The EB-5 investor may be a minority owner of the business.
One may qualify for an EB-5 as follows:
- Invest $1 million and hire ten employees anywhere in the United States
- Invest $500,000 and hire ten employees in an area within the United States where the unemployment rate exceeds the national average unemployment rate by 150%
- Invest in a Regional Center. *
Of the 10,000 investor visas (i.e., EB-5 visas) available annually, 5,000 are set aside for those who apply under a pilot program involving an INS-designated "Regional Center." To date, the quota has not been exceeded.
* INS designated specific areas, called Regional Centers, as eligible to receive immigrant investor capital. INS approved over 20 Regional Centers. Regional Center investors may rely on indirect job creation rather than directly hiring ten employees. A competent professional, such as an economist, must quantify the indirect employment. If the regional center is in a high unemployment area the required capital is reduced to $500,000.
Adjustment of Status
Adjustment of status within the U.S. is available for immediate relatives of spouses or parents of U.S. citizens provided the alien entered with a visa, even though the alien's authorized stay has expired. It is also available to alien applicants who have obtained a labor certification indicating that there are no qualified or available Americans who are capable of performing the services the applicant does, and provided the alien applicant is in authorized status. Also aliens with exceptional ability in the sciences or arts may apply for adjustment of status, if they are in authorized stay and can prove that they possess current widespread acclaim and international recognition requiring exceptional ability.
Nonimmigrant Temporary Visas
We handle non-immigrant visa categories, both at the inception and for extensions, such as:
- B1 & B2 - visitors for pleasure and for business
- E1 & E2 - treaty investors and treaty traders
- F1, M1 - students
- H1A - registered nurses
- H1B - professionals, performing a specialty occupation
- H2A - agricultural workers
- H2B - seasonal and short-term workers
- H3 - trainees
- H4 - dependents
- I - journalists, news media
- J & Q - exchange visitors
- K - fiancées
- L - intracompany transferees
- O - aliens of extraordinary ability in the arts, sciences or business
- P - performing entertainers and athletes
- P1 - internationally known athletes and entertainment groups
- R - religious workers
Citizenship/Naturalization
We can review a client's residency to determine eligibility and also appraise impediments to citizenship that may arise from an arrest, failure to register for selective service, substantial stays abroad, failure to prepare and file proper income taxes, and other criteria.
Deportation/Removal Cases
Our outstanding legal staff is dedicated to zealously protecting the rights of our clients. We individualize each case and pursue all available legal remedies. Some of these include Cancellation of Removal, Adjustment of Status and Suspension of Deportation.
